Prodigious France publishes this website available at https://www.prodidigious.fr (the ‘Site’) to provide up-to-date information about Prodigious France both for the Group’s employees and for any professional or private audience interested in finding out more about our communication agency and its achievements. The use of the Site is subject to compliance with the general conditions of access and use set out below and with the laws in force in France, in particular those relating to communications on the Internet.  
Any person accessing the Site undertakes to comply with these General Terms and Conditions of Use (‘T&C’), which may be supplemented by specific conditions for certain services.
Prodigious France reserves the right to modify and update access to the Site and the T&C at any time. These modifications and updates are binding on the user, who must therefore consult this section regularly to check the current version of the T&C. Prodigious France reserves the right to modify or delete all or part of the Site without prior notice and without any obligation to inform users. Prodigious France shall not be held liable in any way.

This Site has been created to provide you with information on the activities of Prodigious France. The Site is intended for your personal, non-commercial use only and does not constitute a contractual offer.

Prodigious France does not guarantee the accuracy, timeliness or completeness of the information contained on the Site, although it makes every effort to do so .

Intellectual property rights

The entire content and structure of the Site and each of its constituent elements, taken together and/or separately (names, designations and signs of any kind, such as logos, distinctive signs and registered or unregistered figurative marks, names of products and services quoted or reproduced on advertising material of any kind, slogans, architecture, texts, photographs, images, illustrations, videos, graphic charter, etc.) are the exclusive property of Prodigious France and/or its clients and/or its technical service providers. Consequently, any reproduction, representation, use, imitation or modification, by any process whatsoever and on any medium whatsoever, of all or part of the Site, of all or part of the various works or trademarks that make up the Site, without having obtained the prior authorisation of Prodigious France or the holders of the trademark rights, is strictly prohibited and constitutes an infringement of copyright that may subject the author to legal proceedings.

Reproductions are permitted for strictly personal use, excluding any use for advertising and/or commercial purposes, provided that they comply with the provisions of article L122-5 of the French Intellectual Property Code.

Image and personality rights

The models, performers and, more generally, all persons depicted in the advertising photographs and films published on this Site have consented to the use of their image for campaigns produced for advertisers who are clients of Prodigious France. Likewise, the employees and managers of Prodigious France whose image is used on this Site have consented to the use of these visual documents in the context of this Site only. Any reproduction, representation or use of these photographs and films by users of the Site is prohibited without the prior written consent of Prodigious France. Any use, even partial, of these documents in breach of the aforementioned obligation will result in legal action being taken against the offender.

Hyperlinks

Prodigious France shall under no circumstances be held liable for providing access to independent websites via hyperlinks on the present Website and shall not be held liable for the content, data, products and/or services available on the said websites or via the said websites and over which Prodigious France has no control.

Hyperlinks to the Website may only be created with the prior written authorisation of Prodigious France. Any request for authorisation must be made by e-mail. Any unauthorised use shall constitute an infringement.

Liability

Although Prodigious France has taken all reasonable steps to ensure that the information and services contained on the Site are reliable and up to date, it cannot be held responsible for any errors, omissions, viruses or the results that may be obtained from the use of the Site. Prodigious France is only obliged to use its best endeavours.
Prodigious France, its directors and employees may not be held liable (i) for any damage resulting from connection to, access to or use of the Site, including damage to your technical environment and to any equipment used to access or use the Site; (ii) for any damage resulting directly or indirectly from consultation of the Site or use of the information available on the Site; (iii) any direct or indirect damage resulting from the use of this Site, in particular any operational, financial or commercial loss or loss and/or deterioration of programs and/or data in an information system, even if Prodigious France has been informed of the possibility of such damage. More generally, Prodigious France does not provide any guarantee, either explicit or implicit, regarding the operation and/or the content of all or part of the Site.
The users undertake not to introduce, intentionally or otherwise, any virus or file of any kind whatsoever that may disrupt the operation of the site; if they do so, they shall bear full responsibility.
The Site endeavours to keep its pages accessible 7 days a week, 24 hours a day, but is under no obligation to do so. It may therefore interrupt access, in particular for maintenance and upgrading purposes. Prodigious France also reserves the right at any time and without prior notice to modify, suspend or even interrupt the distribution of all or part of this Site and in particular links to other sites. Any information and/or advice provided on the Site shall not be construed as a warranty of any kind.

Governing Law

These Terms and Conditions shall be governed by French law. Any disputes arising out of the interpretation thereof shall be referred exclusively to the courts of France.
